Privacy Legislation

Since January 1, 2004, all organizations collecting, using or disclosing personal information in Canada in the course of commercial activities have been required to comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable “substantially similar” provincial legislation.

In addition, as licensed lawyers, we have professional and ethical obligations to keep confidential the information we receive in the context of a lawyer-client and agent-client relationship.

Personal information does not generally include the information we can expect to find on a business card such as name, title or position, business address, telephone number of facsimile number. An e-mail address is considered to be personal information.

We obtain your consent to collect, use and disclose your personal information. Once you retain our services, you have consented to the collection, use and disclosure of your personal information within the course of our representation.

Confidential Information

As licensed lawyers, we are bound by the Rules of Professional Conduct of the Law Society of Upper Canada and we have professional and ethical obligations to keep confidential the information we receive within a lawyer/client relationship. Section 2.03 (1) of the Rules of Professional Conduct states:

A lawyer at all times shall hold in strict confidence all information concerning the business and affairs of the client acquired in the course of the professional relationship and shall not divulge any such information unless expressly or impliedly authorized by the client or required by law to do so.

Any information you provide to us within a lawyer/client relationship constitutes confidential information.
